Licensing Standards Officers are a specific post set up by the Government under the Licensing (Scotland) Act 2005.

Their remit covers:

  1. Providing to interested persons, information and guidance concerning the operation of the new Licensing Act
  2. Supervising the compliance by the holders of premises and occasional licences in respect of the licences that they hold. This monitoring aspect will ensure an ongoing check is in place and that licence holders are observing the licensing principles as well as conditions placed upon the grant of their licences
  3. Providing mediation services for the purpose of avoiding or resolving disputes or disagreements between premises and occasional licence holders and any other persons

A Licensing Standards Officer (LSO) has a statutory right to enter and inspect licensed premises for the purposes of determining whether the activities on the premises are being carried out in accordance with the Act. The LSO may also request to see any substances, articles or documents they see fit.
