The Committee is invited to note that the appeal to the Directorate of Planning and Environmental Appeals against non determination of the above application has been allowed and the S75 Planning Obligation has been discharged.  The Reporter determined that the planning obligation was no longer necessary as the Council confirmed that, following the decision of the Development and Infrastructure Committee at its May meeting, such obligations would no longer be required and therefore the obligation would now be discharged.  (The determination does not take effect until the date on which the Reporters notice is given is registered in the Land Register of Scotland.)

The Committee is invited to note that the above application was called in by Scottish Ministers for their determination on 25 September 2015.  Scottish Ministers agreed with the conclusions of the reporter appointed to consider the application and adopted them for the purpose of their own decision and therefore accepted the Reporters recommendation that full planning permission should be refused.  Accordingly the application was refused by Scottish Ministers.
