1.  Apologies for Absence


Apologies for absence were intimated on behalf of Mrs Deirdre Mackay and Mrs Katrina MacNab.

 

2.  Minutes of Previous Meeting


Members were advised that the Minute of Meeting of the Licensing Board held on 27th January 2008 will follow with the Agenda for the next meeting.

 

3.  Over Provision Statement


There was circulated Report CSER/LIC/1/09 dated 17th February 2009 by the Clerk. 


The Board noted the duty to assess over provision of licensed premises or licensed premises of a particular description in any locality, and approved the categories of licensed premises and the general approach to the issue of over provision assessment.  While noting the statutory requirement to assess over provision members commented that there had not in the past been any questions of over provision in this area as market forces had limited the number of premises.  The Board requested that in addition to the statutory consultees detailed at paragraph 7 of the report, community councils be consulted, and suggested that detailed guidance be given to consultees to ensure that representations are balanced and appropriate.   Subject to the foregoing the Board approved the report.  

 

4.  Licensing (Scotland) Act 1985 – Applications for Premises Licences – Conversion Applications
