Minute of Meeting of the Caithness, Sutherland and Easter Ross Licensing Committee held in Helmsdale Community Centre, Helmsdale

1.  Apologies for Absence

 

Apologies for absence were intimated on behalf of Mr Michael Finlayson and Mr David Flear.


2.  Minutes of Meetings

 

The Minutes of the Meetings of the Licensing Committee held on 18 December 2007, and 22 January 2008 were approved. 

 


3.  Civic Government (Scotland) Act 1982 – Suspension Hearing – Taxi Driver’s Licence

 

The Committee was invited to consider whether Mr William More (from Wick Caithness Ward), a taxi driver currently licensed, continued to be a fit and proper person to hold such a licence.

 

A copy of the Council’s Hearing’s Procedure had been circulated with the agenda for the meeting.  Mr More was present at the meeting.  Mrs Sinclair explained that Mr More, a licensed taxi driver, had reported to the Council [text removed from web version in compliance with Data Protection Act 1998].  Mr More explained the background [text removed from web version in compliance with Data Protection Act 1998].

 

After discussion, the Committee agreed not to suspend Mr Mackay’s taxi driver’s licence.  

 

4.  Civic Government (Scotland) Act 1982 – Application for Taxi Driver’s Licence

 

The Committee was invited to consider an application for a taxi driver’s licence by Mr Alistair Turner (from Tain and Easter Ross Ward).

 

A copy of the Council’s Hearing’s Procedure had been circulated with the agenda for the Meeting.  Mr Turner was present at the meeting.  Mrs Sinclair explained that there had been no objections to the application and that the [text removed from web version in compliance with Data Protection Act 1998]. She advised that Mr Turner had held a private hire car driver’s licence [text removed from web version in compliance with Data Protection Act 1998]. She said that the Committee in determining the application had to decide whether Mr Turner was a fit and proper person to hold a taxi driver’s licence.  Mr Turner explained the background [text removed from web version in compliance with Data Protection Act 1998].


 
At the conclusion of the hearing the Committee agreed to grant Mr Turner’s application for a taxi driver’s licence for a period of three years and subject to the standard conditions.  

 


5.  Civic Government (Scotland) Act 1982 – Application for Taxi Driver’s Licence

 

The Committee was invited to consider an application for a taxi driver’s licence by Mr Michael Heddle.

 

A copy of the Council’s Hearing’s Procedure had been circulated with the agenda for the Meeting.  Mrs Sinclair explained that there had been no objections to the application and that [text removed from web version in compliance with Data Protection Act 1998]. She said that the Committee in determining the application had to decide whether Mr Heddle was a fit and proper person to hold a taxi driver’s licence.

 

The Committee noted that Mr Heddle was not present at the meeting, and agreed to defer consideration of the application to the next meeting, to allow Mr Heddle a further opportunity to be present to explain the background [text removed from web version in compliance with Data Protection Act 1998].

 


6.  Civic Government (Scotland) Act 1982 – Application for Public Entertainment Licence

 

Mrs Sinclair advised the Committee that the application for a public entertainment licence lodged by Mrs Carol Smith (from Wick Caithness Ward) in respect of Body Beautiful, 2 Dempster Street, Wick had been withdrawn.  The Committee noted the position.

 

The meeting concluded at 11.15 am.
