A Minute of the meeting of The Highland Licensing Board, Inverness, Nairn & Badenoch and Strathspey which was held in the Council Chamber, The Town House, Inverness on Tuesday 12 August 2008 at 10.00am.

2. Confirmation of Minutes
There were submitted for confirmation as a correct record the Minutes of Meeting of the Licensing Board held on 15th July 2008.

3. The Licensing (Scotland) Act 1976
Application for Revocation of Evening Restriction Order
The Victoria Hotel, 57 High Street, Nairn and Robert Beckwith.
Papers were circulated to Members of the Board: Letter from Northern Constabulary to Mr Beckwith dated 23rd July 2008, Letter from Donald & Henderson dated 18th July 2008 to the Clerk and correspondence from Donald and Henderson dated 11 August 2008 also to the Clerk.
Mr Milne, representing Mr Beckwith, stated that his client had not received intimation of the Hearing which was held on 15th July 2008 and which had been the reason for his non-attendance at that meeting. The Clerk confirmed that the Post Office had traced the Intimation to a delivery date of 12 June 2008 to the address stated.
Mr Milne stated that all issues referred to in the letter by the Northern Constabulary dated 23rd July 08 had now been addressed and he requested that the Evening Restriction Order be lifted.
Inspector David Bushell stated that he had concerns in respect of public safety at the premises. He noted that on 18th July an incident had occurred whereby, although Mr Beckwith had arranged for trained door staff to be in attendance, on inspection, it had been noted that a side door to the premises was being operated unmanned and unchecked.
Mr Beckwith stated that this had been an accident, mainly due to lack of communication between management and the door staff present.
Inspector Bushell further stated that despite many warnings and visits the licensing of door staff had taken many months to achieve. He confirmed that applications for door stewarding licensing had only been made 4 weeks ago.
Members raised concerns about the management of the premises and noting that the Clerk was in possession of a further application to transfer the licence, Peter Corbett suggested that the Board defer consideration of the application.
Seconded by Pauline Munro, the Board agreed the motion to DEFER consideration of the application to a future meeting of the Licensing Board.
4. The Gambling Act 2005
Application for Betting (Track) Premises Licence
Tulloch Caledonian Stadium, Stadium Road, Inverness per Inverness Thistle & Caledonian FC Ltd.
Noting the declaration of financial interest made by John Ford for this Item which rendered the Board inquorate, the Board DEFERRED consideration of the application to a future meeting of the Licensing Board.
