Minute of the Meeting of the Ross, Skye and Lochaber Licensing Committee held in the Council Chamber, Council Offices, Lochaber House, Fort William on Tuesday 17th May 2009 at 11.00 am.

1. Apologies for Absence

Apologies for absence were intimated on behalf of Mr Craig Fraser, Mr John Laing, Mrs Angela MacLean, Mr Drew Millar and Mrs Jean Urquhart. 

The Committee wished Mr Fraser who was in hospital a speedy recovery.

The Committee noted that Mrs Jean Urquhart had indicated her wish to resign from the Committee and the Area Solicitor agreed to contact Mrs Urquhart to confirm the position.

2. Confirmation of Minutes

There had been circulated for confirmation  the Minute of the Meeting of the Ross, Skye and Lochaber Licensing Committee held on 21 April 2009.

The Minute was held as read and approved.

3. Exemption for Premises to Hold a Late Hours Catering Licence      

There had been circulated Report No LCR-021-09 (27kb)  by the Area Solicitor relating to an application for an Exemption to hold a Late Hours Catering Licence.

The Committee agreed as follows:

a) to exempt premises from the requirement to hold a Late Hours Catering Licence for the purposes of the 2009 Mountain Bike World Cup Event with powers being delegated to the Area Solicitor in consultation with the Police to determine applications received and attach appropriate conditions. 

b) that the terminal hour be 1.00am during the period 5th to 7th June inclusive.

4. Notification of Conviction

There had been circulated Report No LCR-022-09 (16kb)  by the Area Solicitor relating to the notification of a conviction by a Taxi operator/Driver.

The Committee noted from the Area Solicitor that a letter of objection had been received from Northern Constabulary and agreed that consideration of the matter be deferred to a future meeting for a hearing to be convened.

5. Hearing - Application for a Private Hire Car Licence                  

There had been circulated Report No LCR-023-09 (19kb)  by the Area Solicitor relating to an application for a Private Hire Car Licence submitted by Joseph Blakey. for a vehicle which was more than 5 years old contrary to the Council’s vehicle specification.

Mr Blakey was invited to address the Meeting during which the Committee noted that he was seeking a private hire licence in order to conduct wildlife tours and had presented to the Committee a leaflet which promoted his business. 

The Area Solicitor tabled background papers in relation to the application from which it was noted that the applicant’s vehicle was over five years old and had failed its first vehicle inspection but had subsequently passed a re-inspection.

The Committee agreed:

a) that the application be granted;

b) that future applications involving vehicles more than 5 years old could be approved by the Area Solicitor using his delegated, provided the vehicle had passed inspection and he was otherwise happy to do so.

6. Application for a Public Entertainment Licence

There had been circulated Report No LCR-024-09 (19kb)  by the Area Solicitor relating to an application for a Public Entertainment Licence submitted by Avoch Amenities Association and Jenye Monckton, for the Community Centre, Old Mill Road, Avoch.  

The Report recommended that the Committee agree to defer determination of the application, either:-

a) to allow it to be approved under delegated powers; or,

b) to a future meeting of the Committee when it would be determined in terms of the Hearings Procedure.

The Committee agreed the recommendation.

7. Licences Granted under Delegated Powers under the Civic Government (Scotland) Act 1982, and Marriage (Approval of places) (Scotland) Regulations 2002                                                                   

There had been  circulated and noted Report No LCR-025-09 (18kb) by the Area Solicitor relating to the Licences granted under delegated powers under the Civic Government (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland) Regulations 2002 granted in the period 8th April 2009 to 7th May 2009.
