Minute of the Meeting of the Ross, Skye and Lochaber Licensing Committee held in the Council Offices, Tigh na Sgire, Park Lane, Portree on Tuesday 15th September 2009 at 11.00 am.

1. Apologies for Absence

 

Apologies for absence were intimated on behalf of Mr David Alston, Mr Craig Fraser, Mr Allan Henderson and Mrs Jean Urquhart.

 

2. Confirmation of Minutes

 

There had been circulated for confirmation the Minute of the Meeting of the Ross, Skye and Lochaber Licensing Committee held on 18th August 2009.

 

The Minute was held as read and subject to removing Mr John Laing’s name from the list of those present, approved.

 

3. Timetable of Meetings for 2010

 

There had been circulated Report No LCR-044-09 by the Area Solicitor recommending the following dates for meetings in 2010:

26 January 2010 3 August 2010
9 March 2010 14 September 2010
20 April 2010 26 October 2010
1 June 2010 7 December 2010

The Committee agreed the recommendation.

4. Hearing – Application for Private Hire Car Driver’s Licence – Calum Kerr

There had been circulated Report No LCR-045-09 by the Area Solicitor relating to an application for a Private Hire Car Driver’s Licence which disclosed a previous conviction.

Having considered written submissions from the Applicant and the Police, who offered no objection, the Committee agreed to grant the application subject to the standard conditions.

5. Application for a Public Entertainment Licence – Black Isle Show Ground, Muir of Ord

There had been circulated Report No LCR-046-09 by the Area Solicitor relating to an application for a Public Entertainment Licence submitted by the Black Isle Farmers’ Society.  The Report recommended that the Committee agree to defer determination of the application, either (a) to allow it to be approved under delegated powers or (b) to a future meeting of the Committee when the Application would be determined in terms of the Hearings Procedure.

The Committee agreed the recommendation.

6. Application for a House in Multiple Occupation Licence – Staff Block, Tigh an Eilean Hotel Shieldaig

There had been circulated Report No LCR-047-09 by the Area Solicitor relating to an application for a House in Multiple Occupation Licence submitted by Kathryn Field on behalf of Ceol Mor Partners.  The Report recommended that the Committee agree to defer determination of the application, either (a) to allow it to be approved under delegated powers or (b) to a future meeting of the Committee when the Application would be determined in terms of the Hearings Procedure.

The Committee agreed the recommendation.

7. Application for a Civil Marriage Venue Approval – The Ceilidh Place, Ullapool

There had been circulated Report No LCR-048-09 by the Area Solicitor relating to an application for a Civil Marriage Venue Approval submitted by Mrs Jean Urquhart.  The Area Solicitor advised that this Report had been withdrawn and the application granted under delegated powers following receipt of a response from the Fire Service indicating no objections.

The Committee noted the position.

8. Application for a Civil Marriage Venue Approval – The Royal Hotel, Ullapool


There had been circulated Report No LCR-049-09 by the Area Solicitor relating to an application for a Civil Marriage Venue Approval submitted by Marie Scott.  The Report recommended that the Committee agree to defer determination of the application, either (a) to allow it to be approved under delegated powers or (b) to a future meeting of the Committee when the Application would be determined in terms of the Hearings Procedure.

The Committee agreed the recommendation.

9. Licences Granted under Delegated Powers under the Civic Government (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland) Regulations 2002

There had been circulated and noted Report No LCR-050-09 by the Area Solicitor relating to the Licences and Approvals granted under delegated powers in terms of the Civic Government (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland) Regulations 2002 for the period 6th August 2009 to 2nd September 2009.

There being no further business, the meeting concluded at 11.15 am.
