Minute of the Meeting of the Ross, Skye and Lochaber Licensing Committee held in the Council Chamber, Lochaber House, High Street, Fort William on Tuesday 20th October 2009 at 11.00 am.

1. Apologies for Absence

Apologies for absence were intimated on behalf of Mr David Alston, Mr Craig Fraser, Mrs Angela MacLean and Mrs Jean Urquhart.

2. Confirmation of Minutes

There had been circulated for confirmation the Minute of the Meeting of the Ross, Skye and Lochaber Licensing Committee held on 15th September 2009.

The Minute was held as read and approved.

3. Applications for Taxi Driver Licences

There had been circulated Report No LCR/051/09 by the Area Solicitor on three applicants who had yet to make an appointment to sit the required knowledge test.

The Committee agreed to allow the applicants until the next meeting to sit the knowledge test.

4. Taxi Operator/Taxi Driver – Notification of Conviction

There had been circulated Report No LCR/052/09 by the Area Solicitor advising that the holder of a Taxi operator’s Licence and a Taxi Driver’s Licence had notified the Council that he had received a conviction for careless driving but that he had lodged an appeal against conviction which had yet to be determined. The Report recommended that no action be taken to consider whether the licence holder continued to be a fit and proper person to hold the licences until after the appeal had been determined.

The Committee agreed the recommendation.

5. Hearing - Application for a Taxi driver’s Licence – William Alasdair MacLeod

There had been circulated Report No LCR/053/09 by the Area Solicitor relating to an application for a Taxi Driver’s Licence which disclosed a number of convictions. A report from the Police had not yet been received.

The Committee agreed to defer consideration of the application to a Hearing at their next meeting.

6. Application for a Civil Marriage Venue Approval – Cromarty Courthouse

There had been circulated Report No LCR/054/09 by the Area Solicitor relating to an application for a Civil Marriage Venue Approval from Mrs Janice Hogg on behalf of Cromarty Courthouse Museum Trust.  The Report recommended that the Committee agree to defer determination of the application, either (a) to allow it to be approved under delegated powers or (b) to a future meeting of the Committee when the Application would be determined in terms of the Hearings Procedure.

The Committee agreed the recommendation.

7. Licences Granted under Delegated Powers under the Civic Government
 (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland)  Regulations 2002

There had been circulated and noted Report No LCR/055/09 by the Area Solicitor relating to the Licences and Approvals granted under delegated powers in terms of the Civic Government (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland) Regulations 2002 for the period 3rd September 2009 to 9th October 2009.

8. Application for a Public Entertainment Licence – Black Isle Leisure Centre

There had been circulated Report No LCR/056/09 by the Area Solicitor relating to an application for a Public Entertainment Licence submitted by Ian Goode on behalf of Highland Council.  The Report recommended that the Committee determine this application in terms of the Hearings Procedure due to outstanding remedial work required to lifting equipment.

The Committee, having heard that the outstanding work had now been completed agreed to grant the application subject to the standard conditions.

There being no further business, the meeting concluded at 11.20 am.
