1. Apologies for Absence

2. Confirmation of Minutes
There had been circulated for confirmation the Minute of the Meeting of the Ross, Skye and Lochaber Licensing Committee held on 17th November 2009.
The Minute was held as read and approved.
3. Application for a Late Hours Catering Licence – Tesco Stores Ltd
There had been circulated Report No LCR-062-09 by the Area Solicitor relating to an application for a Late Hours Catering Licence.
The Committee noted that since the Agenda had been issued a response had been received from the Fire Service and that the application had been approved under delegated powers.
4. Application for a Public Entertainment Licence – Aultbea Community Hall
There had been circulated Report No LCR-063-09 by the Area Solicitor recommending that the Committee agree to defer determination of the application, either (a) to allow it to be approved under delegated powers in the event that no further unresolved objections were received and the necessary documentation was submitted or (b) to a future meeting of the Committee when the application would be determined in terms of the Hearings Procedure.
The Committee agreed the recommendation.
5. Hearing - Application for variation of a Public Entertainment Licence – Gairloch Community Hall
There had been circulated Report No LCR-064-09 by the Area Solicitor inviting the Committee to determine the application in accordance with the Hearings Procedure as observations had been received from Northern Constabulary.
Having heard from Mrs Dorothy Malone on behalf of Gairloch Community Hall Committee and Chief Inspector Mike Coats, Northern Constabulary, the Committee agreed to grant the application subject to the standard conditions.
Mrs Angela MacLean declared a non financial interest in item 6 following as she had moved refusal of planning permission for the development and left the meeting while the application was determined.
6. Hearing - Application for a House in Multiple Occupation Licence – Vulcan Cottage, Great North Road, Muir of Ord
There had been circulated Report No LCR-065-09 by the Area Solicitor relating to an application from Ashington Brooke Ltd inviting the Committee to determine the application in accordance with the Hearings Procedure.
Objections had been received from:
- Building Standards,
- Environmental Health,
- Mr David Chisholm
- Mr David Edes
- Muir of Ord Community Council.
The Committee was addressed by Mr Richard Peasnall on behalf of the Applicants, the objectors Mr David Chisholm and Mr David Edes and Robin Fraser, Environmental Health.
The Committee were advised that the Applicant’s appeal against the refusal of planning permission had been successful.
The Committee agreed to grant the application subject to the usual conditions and provided all the required certification was in place and that all the required outstanding works were completed to the Council’s satisfaction.
7. Applications for Taxi Driver Licences – Ian Graves, Bruce Telford and Victoria Pestell
There had been circulated Report No LCR-066-09 by the Area Solicitor inviting the Committee to determine three applications where the applicants had either failed or not sat the required knowledge test.
The Committee agreed to refuse the applications on the grounds that the applicants by not passing the knowledge test had not satisfied the Committee that they were fit and proper to hold a taxi driver’s licence.
8. Application for Taxi Driver’s Licence – Derek Love
There had been circulated Report No LCR-067-09 by the Area Solicitor recommending that the Committee defer consideration of the application to allow the applicant to sit the required knowledge test failing which the application would be referred back to Committee for determination.
The Committee agreed the recommendation.
9. Licences Granted under Delegated Powers under the Civic Government (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland) Regulations 2002
There had been circulated and noted Report No LCR-068-09 by the Area Solicitor relating to the Licences and Approvals granted under delegated powers in terms of the Civic Government (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland) Regulations 2002 for the period 6th November 2009 to 3rd December 2009.
