Minute of the meeting of the Ross, Skye and Lochaber Licensing Committee held in the Council Chamber, Council Offices, High Street, Fort William on Tuesday, 3 August 2010 at 11.00 am.

2. Confirmation of Minutes

 

There had been circulated for confirmation the Minute of the Meeting of the Ross, Skye and Lochaber Licensing Committee held on 1st June 2010.

 

The Minute was held as read and approved.

 

The Committee agreed to consider item nos. 7 to 10 on the Agenda next as item nos.  3 to 6 related to Hearings which Councillor Drew Millar could not participate in via video conference.

 

7. Application for Renewal of Street Trader’s Licence – Innes Dick 


                                                                                                             
There had been circulated Report No LCR-032-10 (21kb pdf)  by the Area Solicitor inviting the Committee to consider the application for trading hours outwith policy, namely the hour of commencement being 8.00am. 

 

The Committee agreed to grant the application with the hours of commencement being 8.00am.

 

8. Application for Renewal of Public Entertainment Licence – Gordon Memorial Hall       

                                                                         

There had been circulated Report No LCR-033-10 (13kb pdf)  by the Area Solicitor recommending that the Committee agree to defer determination of the application, either (a) to allow it to be approved under delegated powers or (b) to a future meeting of the Committee when the application would be determined in terms of the Hearings Procedure.

 

The Committee agreed the recommendation.

 

9. Application for Renewal of Public Entertainment Licence – Cromarty Victoria Hall            

                                                                      

There had been circulated Report No LCR-034-10 (18kb pdf) by the Area Solicitor recommending that the Committee agree to defer determination of the application, either (a) to allow it to be approved under delegated powers or (b) to a future meeting of the Committee when the application would be determined in terms of the Hearings Procedure.

 

The Committee agreed the recommendation.


 
10. Licences Granted under Delegated Powers under the Civic Government (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland) Regulations 2002               

                                      

There had been circulated and noted Report No LCR-035-10 (23kb pdf) by the Area Solicitor relating to the Licences and Approvals granted under delegated powers in terms of the Civic Government (Scotland) Act 1982, and Marriage (Approval of Places) (Scotland) Regulations 2002 for the period 21 May 2010 to 22 July 2010.

Mr Millar left the meeting.

 

The Committee then considered the remainder of business in the order of the Agenda.

 

3. Hearing - Application for Taxi Driver’s Licence – Robert James McCluskie


                                                                                       
There had been circulated Report No LCR-028-10 (31kb pdf)  by the Area Solicitor inviting the Committee to determine the application in accordance with the Hearings
Procedure.

 

The Committee noted from the Area Solicitor that Northern Constabulary had lodged an objection which referred to “spent” convictions under the Rehabilitation of Offenders Act 1974. Members noted from the Police that they were satisfied that the spent convictions did not affect the applicant’s fitness to drive a taxi and the Committee therefore agreed to exclude the letter of objection from their consideration of the application. 

 

The Committee was then addressed by Mr Niall Macbeath on behalf of the applicant who presented the Committee with two letters of support in relation to his client’s application.  The Committee were also advised that the applicant was already the holder of a Taxi Operator’s Licence.

 

The Committee agreed to grant the application subject to the standard conditions.

 

Mr Bren Gormley declared a non-financial interest in the following item and took no part in the discussions thereof.

 

4. Hearing - Application for Taxi Driver’s Licence – Alexander MacDonald

Procedure.

 

Mr Alexander MacDonald addressed the Committee and after noting that no objections or representations had been received in respect of the application, the Committee agreed to grant the application subject to the standard conditions.

 

5. Hearing - Application for Taxi Driver’s Licence – Raymond Munro

Procedure.

 

Mr Raymond Munro addressed the Committee and after noting that no objections or representations had been received in respect of the application, the Committee agreed to grant the application subject to the standard conditions.
