The Committee agreed to note the list of delegated decisions on planning applications from 28th February 2011 to 10th April 2011 which was available on the Members’ Bulletin and via the Highland Council website.

 

4. Planning Applications to be Determined

There had been circulated Report No PLR/034/11 by the Area Planning and Building Standards Manager recommending the grant of the application subject to the conditions detailed therein.

 

The Committee noted that there was an error in the description of this item in the Agenda which referred to an earlier scheme which had been revised to the one detailed in the Report.

 

Following discussion, Mr John Laing, seconded by Mrs Isobel McCallum moved that the application be deferred to a Site inspection at 10.30 am on Monday 9th May 2011 to be followed by a Hearing to determine the application to be held in the Council Chamber, Tigh na Sgire, Park Lane, Portree.

 

As an amendment, Mr David Chisholm moved that the recommendation be agreed but there being no seconder the amendment fell.

 

Accordingly the motion became the finding of the meeting.

There had been circulated Report No PLR/038/11 by the Area Planning and Building Standards Manager recommending the refusal of the application for the reasons detailed therein.

 

There had been circulated prior to the meeting an additional letter from the Applicant in support of his application.

 

The Acting Area Roads and Community Works Manager updated his advice contained in the Report by confirming that the Applicant would not require to construct the access to adoptable standards as the proposed house would be the fourth dwelling served by an unadopted road and therefore fell within the Council’s guidelines in this regard.

 

Following discussion, Mr Bren Gormley, seconded by Mr Eddie Hunter, moved for the undernoted reason that the application be agreed subject to conditions to be agreed by the Area Planning and Building Standards Manager in consultation with the local members present and the Chairman.

 

Reason: This proposal represents a natural extension to the settlement pattern forming part of the family croft which given the physical relationship with adjacent buildings allows it to be considered as a minor departure from policy.

 

As an amendment, Mr David Chisholm, seconded by Mr Hamish Fraser moved that consideration of the application be deferred to allow the Applicant to produce additional information to establish the full extent of engineering works for the construction of the house, access and parking, remedial work for slope stability, water course management and the identification of all trees to be felled.

There had been circulated Report No PLR/039/11 by the Area Planning and Building Standards Manager recommending the grant of the application subject to the conditions detailed therein.

 

Following discussion, Mrs Isobel McCallum, seconded by Mr Billy Barclay, moved that the application be refused for the following reasons.

 

Reasons:

 

1. the proposal does not relate well to the settlement pattern and is contrary to the hinterland policy;

 

2. there is no operational justification for a house;

 

3. it does not represent a cluster as defined by policy and in this regard the proposal represents over development;

 

4. it would result in linear/ribbon development which does not accord with the dispersed settlement pattern in Knockfarrel.

 

As an amendment, Mr David Chisholm, seconded by Mrs Margaret Paterson moved that the recommendation be agreed.

There had been circulated Report No PLR/041/11 by the Area Planning and Building Standards Manager recommending the grant of the application subject to the conditions detailed therein.

 

Following discussion, Mr David Chisholm, seconded by Mr Billy Barclay, moved that the recommendation be agreed subject to condition 1 being amended to require the Applicant to submit for approval details of new outdoor seating and tables and that said outdoor seating and tables be removed at the end of business each day and stored in the premises. The amended condition and, in due course, the amended design to be agreed by the Area Planning and Building Standards Manager in consultation with the local members present and the Chairman.

 

There being no amendment, the motion became the finding of the meeting.

5.     Decisions of Appeals to the Scottish Government Directorate for Planning and Environmental Appeals

The Committee noted that the appeal had been allowed, with the prior conclusion of a Section 75 Agreement to secure affordable housing provision.

Location: Croft 104/105 Lochyside, Caol, Fort William
Nature of Development: Erection of Four Houses

 

Members noted that the appeal had been dismissed.  

 

6.    Tree Preservation Orders

 

6.1   Tree Preservation Order No 110, 2010 – Dingwall North

 

There had been circulated Report No PLR-043-11 (16kb pdf) by the Director of Planning and Development intimating that a provisional Tree Preservation Order had been served on an area of woodland at Dingwall North and recommending that Committee confirm the Order as it stands but with the provision for future adjustments as outlined in paragraph 3.4 of the Report.

 

The Committee agreed the recommendation.
