1. Apologies for Absence
Apologies for absence were intimated on behalf of Councillors MacDonald, MacNab, Mowat and Smith.
2. Exempt Business
The Committee resolved that under Section 50(A) of the Local Government (Scotland) Act 1973 the public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs1, 6 and 9 of Part I of Schedule 7A of the Act.
3. Hearing – Application for a Taxi Drivers Licence
The Committee was invited to consider an application for a Taxi Driver’s Licence lodged by Stephen James Cumming, along with a letter of objection lodged on behalf of the Chief Constable, Northern Constabulary. A copy of the Hearings Procedure had been circulated prior to the meeting.
Mr Cumming appeared in person before the Hearing and intimated that he would be representing himself. Sergeant Stephen Raeburn appeared on behalf of the Chief Constable of Northern Constabulary.
Following submissions on behalf of the applicant and the objector and questions from Members and the parties, the Committee retired to consider the application.
When the meeting resumed, the Committee resolved not to grant the application to Mr Cumming on the grounds that the Committee did not consider him to be a fit and proper person to hold a Taxi Driver’s Licence. Mr Cumming requested that his character reference be returned to him and the Committee so agreed.
4. Hearing – Application for a Taxi Drivers Licence
The Committee was invited to consider an application for a Taxi Driver’s Licence lodged by Nicholas Smith, along with a letter of objection lodged on behalf of the Chief Constable, Northern Constabulary.
Sergeant Raeburn intimated to the Committee that he had been advised by colleagues that Mr Smith had been involved in a road traffic accident on the morning of the hearing and would be unable to attend. The Committee agreed to defer consideration of the application until a later date.
The meeting concluded at 11.10am.
