Minutes of Site Meeting of the Lochaber Area Planning & Building Control Committee held at Albyn Drive, Corpach on Monday 28 August 2000 at 10.45am.

1. Apologies
Apologies for absence were intimated on behalf of Mr Charles King, Dr Michael EM Foxley and Mr & Mrs I Johnstone, Objectors.
Mr George Bruce having previously declared an interest in the application was not present at the Meeting.
2. LO/2000/211 - Erection of Two Houses (Outline) and Formation of Public Open Space/Amenity Area at New Plots 1 and 2 Albyn Drive, Corpach, for Bruce Cameron Associates
There was circulated updated report (no. PL/63) dated 15 August 2000 by the Area Planning Manager relating to a proposal to erect two dwellinghouses on land at Albyn Drive, Corpach which had been specifically allocated for public open space on the Adopted Local Plan.
The Chairman introduced everyone present and outlined the detailed procedures for dealing with Site Meetings.
The Committee noted that the Area Planning Manager recommended that the application be REFUSED for the following reason:-
1) the proposed development of the site for two houses is contrary to the
provisions of the Adopted Local Plan wherein the land is specifically
allocated for public open space/amenity use.
After hearing from the applicant’s representative, objectors, supporters and officials Mr Andrew R McFarlane Slack, seconded by Mr Neil M Clark moved that (1) planning permission be granted subject to conditions being attached to the permission with regard to house size, siting and access arrangements with delegated powers to the Area Planning Manager to finalise the conditions in consultation with the Chairman, Convener and nearest Local Member; and (2) prior to the issue of the consent that a Section 75 Agreement be entered into with the applicants with regard to a contribution towards the provision of public open space in the area. The reason for departing from the Local Plan being the overriding need to resolve the current derelict nature of the site.
As an Amendment Mrs Olwyn J Macdonald, seconded by Mr Brian J Murphy moved that planning permission be refused in accordance with the recommendation of the Area Planning & Building Control Manager, the application being contrary to the provisions of the Adopted Local Plan and the earlier Scottish Executive appeal decision for the Albyn Drive development; and that additionally the landowners be requested to lay the plots out in grass following consultation with the community.
As a second Amendment Mr William MacLachlan moved that planning permission be approved for Plot 1 only with a Section 75 Agreement being entered into to restrict future development on Plot 2. Mr MacLachlan failed to find a seconder and this Amendment fell.
On a vote being taken, there voted for the Amendment 2 and for the Motion 2. The Chairman used his casting vote and declared the Motion to be the finding of the Meeting.
