Minutes of Meeting of the Inverness, Nairn, Badenoch and Strathspey Licensing Committee held in Committee Room 2, Council Headquarters, Inverness on Monday 18th June, 2007 at 10.30 a.m.

1.           Apologies for Absence

 

Apologies for absence were intimated on behalf of Mr T Prag.

 

2.           Application for the Grant of a Second Hand Vehicle Dealer’s Licence

 

In attendance relating to the application:

The Chairman, having explained the Hearings procedure, sought and received confirmation that it was understood by all parties.

 

There had been circulated Report No.  LCI-01/07 dated 4th June, 2007 by the Area Solicitor which related to an application for the grant of a second hand vehicle dealer’s licence.  Mr Elsey summarised the report.  The Committee agreed to accept the late representation by the Northern Constabulary but declined to hear details of the spent convictions.  Submissions were made by Mr Carter and Chief Inspector Henderson. 

 

The Sub Committee GRANTED the application for the grant of a second hand vehicle dealer’s licence.  As Mr Carter had informed that he intended to run the business from premises in Seafield Road he was advised that he would need to apply for a variation of license.

 

3.           Application for Four Public Entertainment Licences

 

There had been circulated Report No.  LCI-02/07 dated 4th June, 2007 by the Area Solicitor which related to applications for four public entertainment licences.

 

In attendance relating to the application:

 

  • Mr Jonathan Warde - Highland Council Education, Culture and Sport                                               
  • Mr John Lee - Highland Council Environmental Health

 

Mr Elsey summarised the report and then submissions were made by Mr Warde and Mr Lee. 

 

The Sub Committee GRANTED a full public entertainment licence for Ardersier Hall and GRANTED public entertainment licences for a 10 month period for Cannich Hall, Smithton Hall and Fort Augustus Hall.

 

4.           Licensed Private Hire Car Driver – Notification of Fixed Penalties

 

Mr N Donald declared a non-financial interest as a Taxi Driver for Highland Council and left the room for this item.

 

There had been circulated Report No.  LCI-03/07 dated 25th May, 2007 by the Area Solicitor which related to a licensed private hire car driver who had received two fixed penalties.

 

In attendance relating to this item:

 

  • Mr Alexander Sim  - Applicant                             
  • Mr Gordon Strachan - Applicant’s Employer

 

Mr Elsey summarised the report and then submissions were made by Mr Sim and Mr Strachan.

 

The Sub Committee AGREED not to suspend Mr Sim’s private hire car driver’s licence in this instance although he was censured by the Chairman.

 

5.           Licensed Taxi Driver – Notification of Penalty Points

 

Mr N Donald declared a non-financial interest as a Taxi Driver for Highland Council and left the room for this item.

 

There had been circulated Report No.  LCI-04/07 dated 6th June, 2007 by the Area Solicitor which related to a licensed taxi driver who had received endorsements on his driving licence.

 

In attendance relating to this item:

 

Mr Andrew MacDonald - Applicant                             

 

Mr Elsey summarised the report and then a submission was made by Mr MacDonald.  

 

The Sub Committee AGREED not to suspend Mr MacDonald’s taxi driver’s licence in this instance although he was censured by the Chairman.

 

 

6.           Future Meeting Dates to January 2008

 

The Committee approved the following future meetings dates.  It was agreed that all meetings would start at 10.00am, unless otherwise arranged, and the venues would be confirmed:

  • Tuesday 31st July, 2007
  • Monday 17th September, 2007
  • Tuesday 30th October, 2007
  • Tuesday 11th December, 2007
  • Tuesday 29th January, 2008
