1. Apologies for Absence
Apologies for absence were intimated on behalf of Mr L Fraser, Mr G Rimell and Mr G Marsden.
2. Minutes of Previous Committee
The Minutes of the meeting of the Committee held on 18th June, 2007 had been circulated and were APPROVED.
Mr N Donald, having declared his interest, sat out of the meeting for the following item.
3. Licensed Taxi Driver – Notification of Penalty Points
Mr N Donald declared a non-financial interest as a Taxi Driver for Highland Council and stated that he would take no part in the discussion nor any voting. He left the meeting for the duration of this item.
There had been circulated Report No. LC/05/07 dated 2nd July, 2007 by the Area Solicitor which related to a licensed Taxi Driver who had received two fixed penalties.

The Committee offered no further questions.
After a severe censure and warning by the Chairman, the Committee AGREED to take no action against the licence holder.
4. Licensing of Late Hours Catering Establishments – Review of Permitted Opening Hours
In attendance relating to item nos. 4, 5, 6, 7 and 8:

There had been circulated Report No. LCI-06/07 dated 2nd July 2007 by the Area Solicitor which related to a consultation process carried out in respect of the opening hours of late hours catering establishments within Inverness.
The Committee had been asked to consider whether or not to extend the permitted opening hours of late hours catering establishments within Inverness.
Mr D Somerville summarised the report.
After discussion Mr D Henry proposed to defer consideration of the application. This was seconded by R Pedersen.
The Committee AGREED to DEFER consideration of the report to the next meeting of the Committee, pending further review.
5. Application for Renewal of a Late Hours Catering Licence
There had been circulated Report No. LCI-07/07 dated 17th July 2007 by the Area Solicitor which related to an application by Mr Maksut Tasasiz in respect of Kebab House, 42 Eastgate, Inverness, for the renewal of a late hours catering licence which would permit trading until 3.00am on Thursday, Fridays and Saturdays, until 1.00am on Sundays and until 12 Midnight on Mondays, Tuesdays and Wednesdays.
The Committee DELEGATED the GRANT of a licence for 3 months.
6. Application for Renewal of Late Hours Catering Licence
There had been circulated Report No. LCI-08/07 dated 17th July 2007 by the Area Solicitor which related to an application by Mr Ahmet Dogaca in respect of Max 2, 2-4 Lombard Street, Inverness, for the renewal of a late hours catering licence which would permit trading until 3.00am on Thursdays, Fridays and Saturdays, until 1.00am on Wednesdays and Sundays and until 12 Midnight on Mondays and Tuesdays.
The Committee DEFERRED consideration of this application to the next meeting of the Committee.
7. Application for the Grant of a Late Hours Catering Licence
There was circulated Report No. LCI-09/07 dated 17th July 2007 by the Area Solicitor which related to an application by Thajudheen Kalodi in respect of Spice Malabar, 32a Church Street, Inverness, for the grant of a late hours catering licence which would permit trading until 3.00am on Thursdays, Fridays and Saturdays, until 1.00am on Wednesdays and Sundays and until 12 Midnight on Mondays and Tuesdays.
The Committee DEFERRED consideration of this application to the next meeting of the Committee and DELEGATED acceptance of submission of temporary licence, to the Area Solicitor, pending the Committee’s review of permitted opening hours at its next meeting.
8. Application for the Grant of a Late Hours Catering Licence
There was circulated Report No. LCI-10/07 dated 17th July 2007 by the Area Solicitor which related to an application by Enbiya Kilig in respect of 44 Baron Taylor Street, Inverness, for the grant of a late hours catering licence which would permit trading until 3.00am on Thursdays, Fridays and Saturdays, until 1.00am on Sundays and until 12 Midnight on Mondays, Tuesdays and Wednesdays.
The Committee DEFERRED consideration of this application to the next meeting of the Committee and DELEGATED acceptance of submission of temporary licence, to the Area Solicitor, pending the Committee’s review of permitted opening hours at its next meeting.
9. Application for the Renewal of a Licence for a House in Multiple Occupancy
Mr J Ford declared a financial interest through his family interests and stated that he would take no part in the discussion nor any voting. He left the meeting for the duration of this item.
Mr P Corbett declared a non-financial interest through his position as Councillor for the area concerned and his wish to speak to his objection and confirmed that he would, therefore, take no part in the discussion nor any voting. He left the meeting for the duration of this item. The Committee AGREED that Mr D Hendry would take the Chair in Mr Corbett’s absence.
This application was subject to a formal hearing procedure.

The Chairman having explained the Hearings procedure, sought and received confirmation that it was understood by all parties.
There had been circulated Report No. LCI-11/07 dated 2nd July 2007 by the Area Solicitor which related to an application by Nina St Charles Limited for 40 Telford Road, Inverness, for the renewal of a licence for a house in multiple occupation.
Representing the applicant, Judith Holland stated her case.
The Objectors were given the opportunity to ask questions of the applicant.
Members were given the opportunity to ask questions of the applicant. There were none.
Mr P Corbett, representing the objectors, stated his case.
Members were given the opportunity to question the objectors.
Mr N Donald proposed that consideration of the application could be better made after scrutiny of an emergency services incident log. This was seconded by Mr R Pedersen.
The Committee AGREED to DEFER further consideration of the application, under the Council’s Hearing Procedure, to the next meeting of the Committee, pending receipt and scrutiny of full emergency services incident log.
The meeting concluded at 11.15am.
