2.           Minutes of Previous Committee

 

The Minutes of the meeting of the Committee held on 29th January 2008 had been circulated and were APPROVED.  

 

3.           Application for the Grant of a Licence for a House in Multiple Occupation

 

The following Members had applied for and been granted local Member votes for this item: Mr J Finnie and Mr D Henderson

 

This application was subject to a formal hearing procedure

 

There was circulated Report No. LCI-06-08 dated 25th February 2008 by the Area Solicitor relating to an application for the grant of a licence of a house in multiple occupation from Mr. Tamer Tasasiz in respect of 42 Island Bank Road, Inverness.

 

Applicants and Objectors were in attendance relating to this item:

 

Mr Rasul, Belvoir Property Management Company representing the applicant

Objectors: Mr A Henderson representing Mr & Mrs C Smith, Mr & Mrs W Fraser and Mr A Henderson

Ms C Grant representing Mrs F McKay

Mr Charlie Grant

 

The Chairman having explained the Hearings procedure sought and received confirmation that it was understood by all parties.

 

The Licensing Officer spoke to report no. LCI-06-08. He confirmed that 8 letters of objection had been received and that the Council’s TEC Services had objected to the application.

 

Following the hearings procedure, during which both the applicant’s representative and the objectors had been invited to state their case, the Chairman sought and received confirmation from all parties that they had been satisfied with the procedure of the hearing.

 

The Members agreed to make their decision on the application in public.

 

Motion

Mr. J Finnie proposed to refuse the application with special regard to the objection made by the Council’s TEC Service.

 

This was seconded by Mr N Donald.

 

Amendment

Mr C Marsden proposed granting the licence for a restricted period of one year.

 

This was seconded by Mrs G. Sinclair

 

Voting

On a vote being taken the Motion was carried by 8 votes to 6

 

Members REFUSED the grant of the application with special regard to the objection made by the Council’s TEC Service (Item 1.9 Report No. LCI-06-08).

 

The Area Solicitor advised the applicant’s representative of his right to seek written reasons and appeal to the Sheriff Clerk.

 

Members: Mrs J Douglas, Mrs B McAllister, Mr D Henderson and  MrJ Finnie left the meeting.

 

4.           Application for the Grant of a Licence for a House in Multiple Occupation

The Chairman having explained the Hearings procedure sought and received confirmation that it was understood by all parties.

 

There was circulated Report No. LCI-07-08 dated 14 January 2008 by the Area Solicitor which related to an application for the grant of a licence for a house in multiple occupation from a Mr Kenneth Meldrum in respect of 7 Broadstone Avenue, Inverness.

 

Following the hearings procedure, during which both the applicant’s representative and the objectors had been invited to state their case, the Chairman sought and received confirmation from all parties that they had been satisfied with the procedure of the hearing.

 

The Members agreed to make their decision on the application in public.

 

After discussion the Committee AGREED to delegate the GRANT of the application to the Area Solicitor, as recommended, for a restricted period of one year, and subject to the required works being carried out and submission of the relevant documentation. Further AGREED that the grant of any renewal of the licence should also be delegated to the Area Solicitor, without further reference to the Committee unless objections or representations were received.

 

5.           Application for the Grant of a Street Trader’s Licence

 

The following Member had applied for and been granted a local Member vote for this item: Mr D Kerr

There was circulated Report No. LCI-08-08 dated 19 February 2008 by the Area Solicitor which related to an application for the grant of a street trader’s licence for Mr. Kim Avis-Gordon.

 

After discussion, and having endorsed the reputation and track record of the applicant, the Members GRANTED the application
