Members are asked to note that an appeal was lodged against the Committee’s decision to refuse planning permission for a 6 house development at 30 Kilmuir, Dunvegan, Isle of Skye. The appeal has been determined by a Reporter appointed by the Scottish Ministers and he has dismissed the appeal and refused to grant planning permission. The Reporter’s decision letter is attached for Member’s further information.

Members are asked to note the Reporter’s decision to DISMISS an appeal lodged against the Planning Authority’s refusal to discharge the planning obligation (formerly known as a Section 75 Agreement) which ties the house granted permission in November 2010 to the land which comprises Hillockhead Holiday Cottages, the business upon which the approval of the Manager’s house was justified. A copy of the decision letter is attached for Member’s information.
6.3 Applicant: Mr C D MacNeill (11/02520/PIP)
Location: Land 70M NE of Tigh An Lis, Tulloch, Dingwall.
Nature of Development: Erection of House (re-submission)
Members of the former Ross, Skye and Lochaber Committee will recall resolving to refuse the above application at their meeting on 13 December 2011, following a site inspection, contrary to recommendation. The Applicant has lodged an appeal against the refusal with Scottish Ministers. Members will be advised of the outcome of the appeal in due course.

The appeal was upheld and the planning permission was granted.
