Response to Clachnacuddin FC going into administration (27/10/09)

The City Committee of The Highland Council will be briefed on the latest developments concerning Clachnacuddin FC at its meeting on Monday 2 November.  This is the date by which the club were due to have produced a business plan setting out how they intended to repay their debt to the Common Good Fund.  At 31 August 2009, the debt stood at £46,534.31.

An option suggested in the letter that was sent to the club following the last City Committee on 21 September was that, on production of the business plan, they might wish to clear the debt within one year ie 12 payments of £3,800.

The request for the business plan by Friday 23 October was to enable officials to give elected members sufficient time to consider the detail ahead of the meeting on Monday 2 November.  

No business plan has been forthcoming. 

The City Committee’s decision of 21 September 2009 was to:

  • to defer a decision to instruct the Area Solicitor to serve appropriate proceedings against Clachnacuddin Football Club (1990) Ltd and its Authorised Officers for the recovery of the entire debt due to the Council, as custodian of the Inverness Common Good Fund, until 2 November 2009;
  • to request that a report be prepared by officials by 2 November 2009 detailing a Development Plan which would provide for full repayment of all sums due by the Company to the Common Good Fund together with proposals for an acceptable rate of return on the Common Good Fund investment; and
  • if after evaluation, the City Manager, in consultation with the Provost and Councillor Kerr, is not satisfied that a credible option for repayment of the debt has been presented, then the Area Solicitor will be instructed to serve appropriate proceedings against the Company immediately, without further referral to the City Committee.
