Contaminated Land

The Highland Council has a duty to inspect land which may be contaminated, and must ensure that land redeveloped through the Planning process is suitable for use.

News

In March 2011, the British Standards Institution published BS10175: 2011 superseding BS10175: 2001 which is now withdrawn. Any new site investigation reports submitted through Planning and Development Control should be undertaken in accordance with BS10175: 2011. Posted August 2011.

As from Monday 4th July 2011, administration charges levied by the Contaminated Land Team for Environmental Information Requests (EIRs) made under provisions of Regulation 8 of the Environmental Information (Scotland) Regulations 2004 will increase from £50 to £52.50 per hour or part thereof. The Highland Council has produced a Notice (PDF 21kb) on changes to Water Environment Assessment Criteria. The Notice is intended to advise Environmental Consultants on the changes to Water Environment Assessment Criteria for inclusion in reports submitted to the Council. All reports submitted to the Council after 1st January 2011 must adhere to the new criteria. Posted October 2010.

The Highland Council has produced a Notice on changes to the Contaminated Land Exposure Assessment (CLEA) Model. The Notice (PDF 22kb) is intended to advise Environmental Consultants on appropriate human health risk assessment methodology for inclusion in reports submitted to the Council. Contaminated Land Inspection Strategy

The Highland Council has a duty to implement the provisions of Part IIA of the Environmental Protection Act 1990, through the Contaminated Land (Scotland) Regulations 2000 and 2005.

Contaminated Land Register

The Highland Council keeps a public register of regulatory action taken in respect of remediation of sites which have met the statutory definition of contaminated land.

The information is provided as a letter and is usually charged at a rate of £52.50 per hour.
