This schedule only covers the areas inspected as they were found at the time of the inspection. It should not be inferred that all hazards and defects within the premises have been identified.  The responsibility for complying with legislation lies with the proprietor and your own checks should be carried out as a matter of routine. 

This schedule contains contraventions and recommendations. Contraventions are items that must be addressed to ensure your compliance with the above legislation. Recommendations are items I strongly recommend be adopted as good practice although they are not direct requirements in terms of the above regulations. All recommendations appear in italic type. When considering work to deal with contraventions there may be other ways of achieving compliance with the law than those I have suggested. Alternatives may be used provided they are of equivalent effect. If you are in doubt as to the acceptability of alternatives please contact me.

Please note that Regulation 17 of the Food Hygiene (Scotland) Regulations 2006 makes it an offence to contravene or fail to comply with the requirements of EC Regulations 852/2004 and 853/2004. Regulation 4 of the General Food Regulations 2004 makes it an offence to contravene or fail to comply with the requirements of EC Regulations 178/2002.


Food Hygiene Contraventions

1 The loose and missing ceiling tiles in the factory require to be replaced and made secure.
(Regulation (EC) No 852/2004 Article 4(2), Annex II, Chapter II Paragraph 1(c))
   
      2 The top surface of the frozen waste was uncovered at the time of the inspection.  The waste should be stored appropriately covered or contained whilst it is stored in the same freezer as food. 
  (Regulation (EC) 852/2004, Anex II, chapter VI, Paragraph 2).

     3 As you are aware you HACCP document requires to be verified on a regular basis.  The HACCP document should be verified and this verification recorded without delay. 
(Regulation (EC) 852/2004 Article 5 Paragraph 2)

4 It appears that you are failing to carry out any end product testing.  You are reminded once again that you are legally required to carry out such tests on a regular basis.

I  have enclosed a list of laboratories who may be able to assist you in this matter.  Please do not hesitate to contact me if you continue to have difficulties in securing the services of a suitable testing laboratory.

5 It is your responsibility to ensure any person known or suspected to be suffering     from, or to be a carrier of, food borne disease or infection, including vomiting,
     diarrhoea, skin infections, sores and open wounds is excluded from working in
          any  food handling areas, until they have been free of symptoms for 48 hours, or
          medical clearance is obtained.

Food Hygiene Recommendation

6 You are recommended to carry out periodic microbiological testing for pathogens in the factory environment, on the equipment and also on the ice used in the factory.
 
7 The daily record sheets were disorganised and out of order at the time of the inspection.  You are recommended to ensure that the sheets are kept together in sequential order.
