The Examination Report

The Highland Council has now received the Report of Examination for the Highland wide Local Development Plan from the Scottish Government's Directorate for Planning and Environmental Appeals.

This draws to a close the independent examination of the unresolved issues following the consultation on the Highland wide Local Development Plan and now the Council can move forward to adoption of the plan.

The unresolved issues from members of the public, community groups and the development industry have now been considered by the Reporters who have, where necessary, made a series of recommendations as to how the Council should change the Plan. These recommendations are binding on the Council and will be reported to the 18th January 2012 Planning, Environment and Development Committee.

The Examination Process

An examination is a review of the unresolved representations made on the Proposed Highland wide Local Development Plan. The examination is undertaken by a person(s) appointed by Scottish Ministers called a reporter. The administration of the examination process is undertaken by the Directorate for Planning and Environmental Appeals (DPEA). The examination of the Local Development Plan by Scottish Ministers allows for independent scrutiny of unresolved objections. The examination process is on issues, not individual representations.

Progress of the Examination

This page will be updated regularly, and should be your first reference point for information on the progress towards and through the examination.

On 4 May 2011 The Highland Council submitted the Proposed Highland wide Local Development Plan to Scottish Ministers for examination. The Scottish Ministers appointed Mr Trevor A Croft BSc Dip TRP ARSGS FRSA MRTPI, and Mr Malcolm Mahony BA(Hons) MRTPI on 18 May 2011 to carry out the examination of the Highland wide Local Development Plan 2010 in accordance with Section 19(3) of the amended Town and Country Planning Scotland Act 1997. Additional Reporters may be appointed to support the delivery of the report.

Please note that on 10 June 2011 Mr Robert W Maslin BA DipTP MRTPI was appointed as an additional reporter to carry out the examination of the Highland wide Local Development Plan 2010.  A further reporter Mr Iain G Lumsden MA(Hons) MSc MRTPI was appointed in August 2011.
