A meeting of the Highland Licensing Committee will take place in the Council Chamber, Council Headquarters, Glenurquhart Road, Inverness on Tuesday, 10 May 2016 at 10.00 am.

You are invited to attend and a note of the business to be considered is attached.

Members are reminded that during determination of Licensing Items, in order to be entitled to participate in any vote, Members must be present throughout all of the proceedings.

4. Licences granted under delegated powers

There is circulated Report No HLC/041/16 by the Principal Solicitor – Regulatory Services which details all Licences which have been granted under delegated powers under the Civic Government (Scotland) Act 1982 granted in the period from 16 March 2016 to 26 April 2016.

The Committee is invited to note the Report.

5. Pending applications – 3 monthly considerations

There is circulated Report No HLC/042/16 by the Principal Solicitor – Regulatory Services relating to applications which are currently pending for the grant or renewal of licences under the Civic Government (Scotland) Act 1982.

The Report recommends that the Committee agree to defer the determination of the applications, either:

(a) to allow them to be approved under delegated powers in the event that no objections/representations are received and all outstanding documentation has been received from the applicants; or

(b) to a future meeting of the Committee when the applications will be determined in terms of the Hearings Procedure.

6. Taxi and Private Hire Car Licensing – Consultation on the impact of modern technology

There is circulated Report No HLC/043/16 which invites the Committee to consider, and amend if required, the attached draft response to the Scottish Government consultation in relation to the impact of modern technology on taxi and private hire car licensing.  

The Committee is invited to consider the draft response detailed in Appendix 1 and thereafter agree a final response to be returned to the Scottish Government.

There is circulated Report No HLC/044/16 (pp 23-29) by the Principal Solicitor – Regulatory Services relating to a breach of Taxi Operator Licence Conditions.  (Inverness West Ward).

The Committee is invited to determine this matter in accordance with the Council’s Hearings Procedure (pp 55-56).

7.2 Licence holder – John Fraser 

There is circulated Report No HLC/045/16 (pp 30-40) by the Principal Solicitor – Regulatory Services relating to a breach of Taxi Operator Licence Conditions.  (Inverness South Ward).

The Committee is invited to determine this matter in accordance with the Council’s Hearings Procedure (pp 55-56).

8.1 Premises: Stratherrick Public Hall

There is circulated Report No HLC/046/16 by the Principal Solicitor – Regulatory Services relating to an application for a Public Entertainment Licence for Stratherrick Public Hall by the Stratherrick Public Hall Committee .  (Aird and Loch Ness Ward).

The Committee is invited to determine this matter in accordance with the Council’s Hearings Procedure (pp 55-56).

9. The Committee is asked to resolve that, under Section 50A(4) of the Local Government (Scotland) Act 1973, the public be excluded from the meeting during discussion of the following Items on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 7A of the Act.

10.1 Licence holder – Christopher Campbell

There is circulated to members only Report No HLC/047/16 (pp 43– 48) by the Principal Solicitor – Regulatory Services relating to Christopher Campbell who is the holder of a taxi operator’s and a taxi driver’s licence (Inverness South Ward).

The Committee is invited to determine this matter in accordance with the Council’s hearings procedure (pp 55-56).

10.2 Taxi Driver – Colin Brimson 

There is circulated to members only Report No HLC/048/16 (pp 49 –51) by the Principal Solicitor – Regulatory Services relating to Colin Brimson who is the hold of a taxi driver’s licence (Landward Caithness Ward).

The Committee is invited to determine this matter in accordance with the Council’s Hearings Procedure (pp 55-56).
