A meeting of the Highland Licensing Committee will take place in the Council Chamber, Council Headquarters, Glenurquhart Road, Inverness on Tuesday 7 August 2018 at 10.00 am.

You are invited to attend and a note of the business to be considered is attached.

Members are reminded that during determination of Licensing Items, in order to be entitled to participate in any vote, Members must be present throughout all of the proceedings.

4.  Licences granted under delegated powers

There is circulated Report No HLC/049/18  the Principal Solicitor which details all Licences which have been granted under delegated powers under the Civic Government (Scotland) Act 1982  granted in the period from 14 June 2018 to 25 July 2018.

The Committee is invited to note the report.

5.  Pending applications – 3 monthly considerations

There is circulated Report No HLC/050/18 the Principal Solicitor relating to applications which are currently pending for the grant or renewal of licences under the Civic Government (Scotland) Act 1982.

The Report recommends that the Committee agree to defer the determination of the applications, either:

  1. to allow them to be approved under delegated powers in the event that no objections/representations are received and all outstanding documentation has been received from the applicants; or
  2. to a future meeting of the Committee when the applications will be determined in terms of the Hearings Procedure.

6.  Housing (Scotland) Act 2006

6.1  Rent suspension orders in respect of unlicensed houses in multiple occupation

There is circulated Report No HLC/051/18 the Principal Solicitor relating to rent suspension orders in respect of unlicensed houses in multiple occupation. 

The Committee is invited to grant delegated power to the Solicitor – Regulatory Services and the Principal Solicitor – Regulatory Services to make rent suspension orders in respect of properties which are not licensed as houses in multiple occupation (HMO) but which are being used as living accommodation occupied as HMO.

There is circulated Report No HLC/052/18 the Principal Solicitor relating to an application for a public entertainment licence for Culloden Academy Community Complex, Keppoch Road, Inverness by Highlife Highland (Culloden and Ardersier Ward).

The Committee is invited to determine this matter in accordance with the Council’s Hearings Procedure.

8.  Civic Government (Scotland) Act 1982

There is circulated Report No HLC/053/18 the Principal Solicitor relating to an application for a second hand vehicle dealer’s licence by James Mollison (Ward 9 – Black Isle).

The Committee is invited to determine this matter in accordance with the Council’s Hearings Procedure.

9.  The Committee is asked to resolve that, under Section 50A(4) of the Local Government (Scotland) Act 1973, the public be excluded from the meeting during discussion of the following Items on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 7A of the Act.

10.1    Private hire car operator’s licence, taxi operator’s licences and taxi driver’s licence – Thomas Russell    

There is circulated to members only Report No HLC/054/18 the Principal Solicitor relating to Thomas Russell the holder of a private hire car operator’s licence, taxi operator’s licences and a taxi driver’s licence (Thurso and Northwest Caithness Ward).

The Committee is invited to determine this application in accordance with the Council’s Hearings Procedure.

10.2    Application for private hire car driver’s licence – Thomas Russell

There is circulated to members only Report No HLC/055/18 the Principal Solicitor relating to an application which has been received from Thomas Russell for the grant of a private hire car driver’s licence (Thurso and Northwest Caithness Ward).

The Committee is invited to determine this matter in accordance with the Council’s Hearings Procedure.

10.3    Taxi operator’s and taxi driver’s licence – Roy Sweeney

There is circulated to members only Report No HLC/056/18 the Principal Solicitor relating to Roy Sweeney who is the holder of a taxi operator’s and taxi driver’s licence (Aird and Loch Ness Ward).

The Committee is invited to determine this matter in accordance with the Council’s Hearings Procedure.

11.       Review of Taxi Tariff 2018/19

There is circulated Report No HLC/057/18 the Principal Solicitor providing the Committee with details of the responses received following public advertisement of the proposed revised scale of the maximum fares that can be charged by taxis and private hire cars fitted with taxi meters.

The Committee are invited to (i) consider the representations received following advertisement of the proposed tariff, all other further information before it and any submission which any taxi operator attending the meeting may make to the Committee at the meeting and thereafter agree a final tariff, (ii) agree that any revised tariff will take effect from 19 November 2018, subject to any appeal being lodged.
