A meeting of the Highland Licensing Board will take place remotely via Microsoft Teams on Tuesday, 30 March 2021 at 1.00 pm (following the Highland Licensing Committee commencing 10.00 am).

You are invited to attend and a note of the business to be considered is attached.

Members are reminded that during determination of a Licensing Board Item, in order to be entitled to participate in any vote, Members must be present throughout all of the proceedings.

1.  Amendment to S5(f) - in the first instance the facilities at Foyers Lodge are for the use of guests, however, non-residents may occasionally use the facilities when visiting to enjoy table meals and drinks or to attend small events.

2.  Amendment  to S6(c) - Children  aged 12-15 and young persons will be allowed on the premises if accompanied and supervised by an adult.  Children aged 0-11 will not be permitted.

3.  Add off sales Monday-Sunday: commencing at 1000 hrs and terminating at 2200 hrs.

4.  Amend capacity from 16 to 40.

5.  Licensed area to now include the footprint of the entire ground floor as outlined in red - former storage area has now been converted to a self -catering unit comprising a sitting room and bedroom.

6.  Change to premises description to read:

'The premises is a detached traditional Victorian lodge standing in its own grounds in the rural location of Foyers, overlooking Loch Ness.  Residential guests are provided with bed and breakfast/evening meal on the premises.  There are eight guest bedrooms and a one-bedroom apartment.  Alcohol will be sold to such residents and dispensed at the bar in the Drawing Room.

Non-resident guests may use the facilities when occasionally visiting to enjoy table meals or attend small events.

Wine and other alcoholic beverages may be served to residents and non-residents by staff when eating in the Dining Room, Drawing Room or garden.

Residents and non-residents may take drinks into the garden and consume them within the perimeter of the outside licensed area as shown on the layout plan.

Residents and non-residents may purchase drinks to consume off the premises, for example with picnic/packed lunch.  Off sales liquor will be sourced from a stock room or behind the bar on receipt of order; there will be no public display.

The property/premises may be hired out for exclusive use and/or events.  This includes alcohol tasting/sampling events.

The owner/applicant lives in a private flat within the property/premises.'

4.  Change wording for seasonal variations to read: 'The premises will operate according to any periods of extended hours which may be offered by the Highland Licensing Board such as, the Festive Season.'

5.  Amend Children and Young Persons Policy to read: 6(b) Children require to be accompanied by a supervising adult.  Young persons may enter the premises unaccompanied at management discretion until 21.00 hrs for the purposes of food, soft beverages and playing pool.  After 21.00 hrs they require to be in the company of a supervising adult.

6(c) 0-17 years as per the terms of 6(b).

6(d) At all times that the premises are open under the terms of 6(b).

6(e) All parts of the premises to which the public are granted access.

6.  Capacity to increase from 180 to 210.

7.  Current layout plans are amended in order to bring outside areas within the licensing footprint of the premises.  First, the outdoor space adjacent to the car park; second, facing the main public road at the public bar entrance; thirdly, the paddock adjacent to the hotel and car park area will be included within the footprint of the premises to allow events to be hosted e.g. marquee, markets, outdoor eating and drinking spaces.

8.  Description to include: 'The footprint of the premises also include an outside drinking area adjacent to the car park of the hotel, a further drinking terrace along the side of the premises at the public bar entrance as well as the car park and adjacent to the north east of the hotel building.
