THE HIGHLAND COUNCIL (BUGHT LANE (PART), AND BUGHT ROAD (PART) INVERNESS) (TEMPORARY TRAFFIC PROHIBITION AND RESTRICTION) ORDER 2021

The Highland Council in exercise of the powers conferred on them by Section 16A of the Road Traffic Regulation Act 1984, as amended, and of all other powers enabling them on that behalf being satisfied that traffic on the lengths of road referred to in this Order should be prohibited or restricted because licensed events are being or are proposed to be held on or near that length of road hereby make this Order.

Citation, commencement and cessation

  1. This Order may be cited as ‘’The Highland Council (Bught Lane (Part) And Bught Road (Part), Inverness) (Temporary Traffic Prohibition And Restriction) Order 2021’’ and shall come into force at 8:00 hours on Wednesday 20 October 2021 and shall remain in effect until midnight on Sunday 7 November 2021.

Reason

  1. The reason for making this Order is to ensure the safety of event patrons and participants.

Interpretation

  1. The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

Relationship to existing Orders

  1. While this Order is in operation, all provisions contained in any Order Enactment or others in so far as the same repeat or are inconsistent with the provisions of this Order and the true intent and meaning hereof shall cease to have effect.

Reason

  1. The reason for making this Order is to enable a temporary traffic prohibition and restriction to be put in place because licensed events are being or are proposed to be held on or near the length of road specified in the Schedule 1 to this Order.

Alternative Routes

  1. Consideration has been given to the safety and convenience of alternative routes suitable for the traffic which will be affected by this Order.

Temporary prohibition on use of a road

  1. Save as provided for in Article 9 (a), (b) and (c), while this Notice is in force, no person shall drive or cause or permit any vehicle to be driven on the length of road specified in Schedule 1 to this Order when a prohibition is identified as applying to the whole or a part or parts of the length of road by means of one or more of the traffic signs of a type generally provided for under Section 64 of the Road Traffic Regulation Act 1984, as amended.

Temporary one-way restriction

  1. Save as provided for in Article 9 (d), while this Order is in force, no person shall drive, or cause or permit any vehicle to be driven on the length of road specified in Column 1 of Schedule 2 to this Order other than in the direction specified opposite in Column 2 of the said Schedule, when a prohibition is identified as applying to the whole or a part or parts of the length of road by means of one or more of the traffic signs of a type generally provided for under Section 64 of the Road Traffic Regulation Act 1984, as amended.

Exemptions

  1. Nothing in Article 7 applies to:

(a) Pedestrians.

(b) Vehicles displaying a disabled parking scheme blue badge.

(c) Vehicles requiring access to or from premises situated on or adjacent to the said length of road or which are only accessible from the said length of road, and only then at the discretion and by the instruction of the traffic management provider.

Nothing in Article 8 applies to:

(d) Public Service Vehicles.

TEMPORARY PROHIBITION OF TRAFFIC

U4690 Bught Lane, Inverness, commencing at its junction with the U3823 Bught Road and extending in an easterly direction to a roundabout a distance of 105 metres or thereby.
