Grass cutting collective grievance rejected

The Appeals Sub-Committee of The Highland Council’s Resources Committee has dismissed a collective grievance by the GMB Union concerning a proposed transfer of grass cutting staff from the Council to a private contractor.

The trade union challenged the legality of the Council seeking to transfer employees currently on permanent full-time contracts to potentially seasonal work with a private contractor. 

The Sub-Committee took independent legal advice which confirmed that the TUPE transfer regulations did apply.  The all party Sub-Committee, which includes Opposition members,  unanimously rejected the appeal based on the legal advice received. 

The proposal by the Council to put out to tender amenity grass cutting will be discussed at tomorrow’s full Council meeting.
