During the coronavirus period, the Licensing (Scotland) Act 2005 has been temporarily amended to allow Board meetings to take place remotely.

Minute of the meeting of the Highland Licensing Board held remotely on Tuesday 27 October 2020 at 1.00 pm.

Present:

Ms E Knox, Mrs L Macdonald (Convenor), Mr D Macpherson, Mr K Rosie, Mr A Sinclair and Mr C Smith.

Briefing on Protocol for Webcasting of Meetings

The Convener advised the Board that the meeting would be filmed and broadcast over the internet on the Highland Council website and would be archived and available for viewing for 12 months.

3.  Confirmation of minutes

There was submitted for confirmation as a correct record the minute of the meeting of the Highland Licensing Board held on 8 September 2020.

The Minutes were held as read and APPROVED.

4.  Licensing (Scotland) Act 2005
Licences granted under delegated powers

 There had been circulated Report No HLB/68/20 detailing licences which had been granted under delegated powers by the Clerk to the Board during the period 27 August 2020 to 14 October 2020.

The Board NOTED the report.

There had been circulated Report No HLB/69/20 detailing occasional licences and extended hours applications which had been granted under delegated powers by the Clerk to the Board during the period 27 August 2020 to 14 October 2020.

There had been circulated Report No HLB/070/20 by the Clerk.

The Board AGREED to GRANT the provisional premises licence subject to the mandatory conditions.

7.  Application for personal licence

7.1 Applicant: Alan Michael Tomlin (HC/RSL/L/7362)

There had been circulated Report No HLB/071/20 by the Clerk.  The applicant had prepared a written submission for the application which was circulated with the Report and Members were given time to read the submission.

The applicant did not attend.

Following discussion, Mrs L MacDonald, seconded by Ms E Knox moved grant of the personal licence. 

Mr D Macpherson, moved refusal of the personal licence as he did not consider Mr Tomlin to be a fit and proper person to hold such a licence.  There being no seconder the amendment fell.

The Board thereafter AGREED to GRANT the application for a personal licence.

8.  Surrender of premises licence

Licence Holder:  Pamela J Howard

The Board NOTED that the above Premises Licences had been surrendered in terms of Section 28(5)(f).
