Disposal of or change of use of Common Good assets
Consultation Requirements
We must carry out a public consultation before deciding to dispose of, or change the use of Common Good assets as detailed in The Community Empowerment (Scotland) Act 2015. This ensures transparency and gives communities a meaningful opportunity to have their views considered.
How the consultation works
Community Councils and relevant Community Bodies are notified directly and invited to submit representations.
The proposal is publicly advertised, allowing members of the wider community to comment.
All representations received are carefully considered and taken into account as part of the decision-making process.
Additional approvals
In some cases, proposals involving Common Good assets may also require approval from the Sheriff Court before they can proceed.

Common Good asset registers
There are 13 Common Good areas in Highland, each with its own published asset register.
All asset registers are publicly available and are maintained as live documents. This means they are subject to ongoing review and update, particularly as a result of title investigations and further legal clarification.
Users of the registers should be aware that asset listings may change over time as new information becomes available or corrections are identified.
