Smoking and vaping ban

We are responsible for ensuring compliance with the UK’s smokefree legislation across a range of premises, including pubs, restaurants, factories, and other enclosed public and workspaces.

What we do

Our enforcement activities include:

  • education and advice - we support businesses and individuals in understanding their responsibilities under the law
  • formal action - where necessary, we issue fixed penalty notices or pursue prosecution for serious or repeated breaches

Legal penalties

Failure to comply with smokefree laws is a criminal offence. Individuals can be fined £50 for smoking in no-smoking premises.

The manager or person in control of any no-smoking premises can be fined a fixed penalty of £200 for either allowing others to smoke in no-smoking premises, or failing to display warning notices in no-smoking premises.

Refusal to pay or failure to pay may result in prosecution and a fine of up to £2,500.
