THE HIGHLAND COUNCIL (SCHOOL STREETS ZONE) (PROHIBITION OF DRIVING) EXPERIMENTAL TRAFFIC REGULATION ORDER 2026
Description

NOTICE IS HEREBY GIVEN that on the 31st March 2026, The Highland Council made the above Order (“the Experimental Order”) in exercise of the powers conferred on them under Sections 9 and 10 of the Road Traffic Regulation Act 1984 and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to said Act.

The Order will be experimental and will remain initially in operation from the 20th April 2026 for a period not exceeding 18 months.

While the Order is in force, the restrictions will apply during School Term Time for the following schools and the times stated below:

Duncan Forbes Primary School, Inverness

Monday - Friday 8.30-9:15 am 2:15 – 3:15 pm

Kirkhill Primary School, Inverness -

Mon - Thursday 8:30-9:15 am 2:45 – 3:45pm Friday - 08:30 - 9:15; 11.45 – 12.30pm

Pennyland Primary School, Thurso

Mon – Thurs - 8:15 – 9:15am 2:15 – 3:30pm Fri – 8:15 – 9:15 am 12:15 – 1:00 pm

The Order is required to promote Road Safety at the locations provided at Duncan Forbes Primary School, Kirkhill Primary School, and Pennyland Primary School.

When this Experimental Order comes into force, it will introduce a prohibition on the following road over its entire length, unless stated otherwise below:

Duncan Forbes Primary School, Inverness -

U2098 CULLODEN PARK, INVERNESS, From a point 70 metres or thereby from its junction with the U1855 Keppoch Road and extending in a south-easterly direction to the point where it terminates, a distance of 101 metres or thereby.

U2098 CULLODEN PARK, INVERNESS, From a point 116 metres or thereby from the road’s junction with the U1855 Keppoch Road and extending in a north-easterly direction to the point where it terminates in a turning circle, a distance of 183 metres or thereby.

Kirkhill Primary School, Inverness - C1092 ST MARY’S ROAD, INVERNESS From a point 102m northeast of its junction with the U1564 Wardlaw Road, extending in a northeastly direction for 442m or thereby.

Pennyland Primary School, Thurso - U4301 TROSTAN ROAD, THURSO For its entire length.

The order will apply to all vehicles except the following :-

a) a Vehicle being used in connection with any building operation or demolition; the removal of any obstruction to traffic; the maintenance, improvement or reconstruction of the Restricted Roads or part thereof; the laying, erection, alteration or repair in or adjacent to any Restricted Road or part thereof of any sewer or any main, pipe, or apparatus for the supply of gas, water, electricity, or of any electronic communications apparatus; or the placing, maintenance or removal of any traffic sign;

b) an individual, or organisation authorised by the Council;

c) a Vehicle being used for police, fire brigade, coastguard or ambulance service emergency purposes or in the service of a Local Authority and being used in pursuance of statutory powers and duties;

d) a Vehicle displaying a Disabled Person’s Badge, being driven by, or carrying a Disabled Person’s Badge holder to uplift or set down passengers or wait at premises located on the Restricted Roads;

e) a Vehicle displaying in the manner specified in Article 6 of this Order a valid School Streets Zone Permit issued in respect of the use of that Vehicle on the Restricted Roads;

f) a Taxi or Bus or private hire car contracted by the local education authority for the purpose of dropping off or picking up school children from a school specified in the Schedule to this Order;

g) a Vehicle being used in connection with funeral operations;

h) a Vehicle being used by Healthcare Workers or Carers and Support Workers to visit premises situated on the Restricted Roads;

i) a Vehicle being used by Universal Postal Services or being used by a delivery firm in the course of their business delivering or collecting parcels to/from premises on the Restricted Roads.

Comments and objections

The Council will in due course be considering whether the provisions of the Experimental Order should be made permanent.

Any person may object to the making of a future permanent order within a period of 6 months from the date the Experimental Order comes into force or, if the Experimental Order is varied by a subsequent experimental order or modified pursuant to section 10(2) of the Road Traffic Regulation Act 1984, from the date of that variation or modification comes into force. Objections must be made in writing to Scott Hunter, Road Safety Team, Highland Council Trafficorders@highland.gov.uk or Road Safety Team, Glenurquhart Road, Inverness, IV3 5NX and must state the grounds on which they are made. Support for the measures can also be sent to the same postal or email address.

A copy of the Experimental Order, the Plans, and the Statement of Reasons for introducing the prohibitions/restrictions and exemptions that have been introduced by the Experimental Order may be inspected at the Inverness Service Point, Town House, Castle Street, Inverness, IV1 1JJ, during normal opening hours from Monday to Friday 10:00 – 12:30 and 1:30 – 4:30 and Thurso, Strathy and Mey Service Point and Registration Office, Rotterdam Street, Thurso, KW14 8AB, during normal opening hours Monday, Wednesday and Friday, 09:30 – 12:30 and Tuesday and Thursday, 1:30 – 4:30. All documents may also be viewed online at https://www.highland.gov.uk/roadsafety.

Any person wishing to question the validity of the Experimental Order or any of its provisions on the grounds that it is not within the powers of the relevant enabling Act or that a requirement of any such enabling Act or any relevant regulations made thereunder have not been complied with may, within 6 weeks from the date on which the Experimental Order was made, make application for the purpose to the Court of Session
