Guidance for housing land enquiries
You can apply to buy small areas of Housing land – usually narrow strips of grass beside homes or footpaths.
This does not cover:
- Large land areas with development potential
- Community asset transfers
Does not include land with potential for development or new builds.
When might a sale be approved
We may consider a sale if:
- It provides a community benefit (for example, tidying up misused land)
- The land is difficult or costly to maintain
- You have health reasons or other extenuating personal circumstances
In most cases, we will not approve sales that only benefit an individual with no wider purpose.
Costs and fees
It should be noted that the sale process involves the following fees that currently total a minimum of £1,900 (exclusive of VAT):-
- Valuation fee - £800 + VAT
- Legal fees - £1,100 +VAT
If the valuation fee is higher than £800 + VAT, you will be responsible for recovering the actual costs.
You may also need to:
- Apply for planning permission (for example, change of use to garden ground)
- Prepare a deed plan in line with Registers of Scotland rules
- Pay for other statutory permissions if required
