Unpaid Penalty Charge Notices (PCN's)

If you do not pay your PCN

A Notice to Owner will be sent to the registered keeper of the vehicle, as held by the DVLA, if no payment has been received within 28 days of a penalty charge notice or the rejection of your initial challenge.

Notice to owner

The Notice to Owner gives you 28 days from the date it is served to either:

  • pay the PCN in full
  • submit a formal representation to us explaining why you believe the PCN should be cancelled, the grounds for appeal will be listed in the Notice

Charge Certificate

If you fail to pay the PCN after the Notice to Owner or on rejection of a formal representation, then a Charge Certificate will be issued, and the value of the fine will increase by 50%. You will have 14 days from the Charge Certificate being issued to make payment.

Failure to pay the increased amount may result in the Charge Certificate being passed to the Sheriff Officer for collection. This also means that you can no longer submit an appeal to the adjudicator.

If you submit a formal representation

Once we receive your representation, we will carefully review:

  • the details you have provided
  • any mitigating circumstances
  • evidence recorded by the Civil Enforcement Officer
  • information held in our systems

If your representation is accepted, we will cancel the PCN and confirm this in writing.

If your representation is rejected, we will send you a Notice of Rejection along with a form to appeal to the Parking and Bus Lane Tribunal for Scotland. The Notice will explain how to do this.

Late representations

Representations received after the 28-day deadline are not usually accepted, unless there are exceptional circumstances that we may take into account.
