Under the Cost of Living (Tenant Protection) (Scotland) Act 2022, several restrictions have been placed on landlord’s ability to evict their tenants.

When tenants need to leave their property

Tenants do not have a legal responsibility to leave their rented property once the notice to quit or leave period has ended. They may remain in the property until a landlord has secured an eviction order from the Housing and Property Chamber (also known as the First Tier Tribunal for Scotland). This applies to all evictions regardless of the grounds and tenancy types.

We will advise tenants to remain in their property until an eviction order is secured.
