Enforcement powers

We aim to work cooperatively with empty homeowners to bring properties back into use. However, when voluntary efforts fail and a property poses risks to health, safety or the wider community, enforcement powers may be used.


When enforcement may be considered

Enforcement action may be taken if:

  • the property is in serious disrepair
  • there is a risk to public health or safety
  • the property is affecting neighbouring homes
  • the owner has not responded to advice or support

Assessing risk

When deciding whether to take enforcement action, we will consider:

  • location of the danger
  • who is at risk
  • time of year and weather conditions
  • how easy it is to trace the owner
  • whether the owner is willing to act

Compulsory Purchase Orders

As a last resort, we may apply for a Compulsory Purchase Order (CPO) or Sale Order. This can only be used:

  • where it is in the public interest
  • with approval from Scottish Ministers
  • after all voluntary options have been exhausted
