Complying with safety regulations when selling used cars

You must take reasonable steps to ensure vehicles are safe before offering them for sale. This includes checks, documentation and staff training.

You should:

  • check that vehicles meet MOT standards before placing them on the forecourt
  • carry out your own checks or use an MOT testing station
  • complete a pre-sale inspection report
  • keep records of:
    • checks carried out
    • faults found
    • repairs made
    • staff training
    • authorisation to sell

Due diligence defence

You can defend against a GPSR offence by showing you took all reasonable steps to avoid it. This includes:

  • following the steps above consistently
  • carrying out regular audits of your procedures
