The sale of used motor vehicles

MOT information

Be aware that:

  • vehicles do not need an MOT before sale but they must be in a condition that would pass an MOT
  • vehicles over 3 years old must have a valid MOT to be driven on the road, including for test drives
  • defects can still emerge after an MOT is issued. You should check every vehicle before sale, regardless of its MOT status
  • if a vehicle is on display with a price, it is considered offered for supply and must be safe. You cannot avoid liability by marking a car “Awaiting Preparation”
  • it is not enough to give customers a 12-month MOT. Vehicles must be safe when offered for supply, including for test drives. Carry out checks before placing them on the forecourt
  • failing to check vehicles can lead to unsafe cars being sold. Courts may not look favourably on businesses that skip safety checks

  • inspect your premises and records
  • carry out test purchases
  • seize and detain unsafe vehicles
