Submit a Non-Material Variation

Once planning permission has been granted, you may need to make small changes to the approved development for practical or design reasons. If the changes do not significantly alter what was approved, you can ask us to consider them as a non-material variation (NMV)

What is a Non-Material Variation (NMV)?

A non-material variation is a minor change to an approved development that does not significantly change the permission that was granted. We assess this by looking at the scale of the change compared with the approved development and the nature of the surrounding area.

An NMV cannot:

  • introduce development that would need planning permission in its own right
  • change or remove conditions attached to a planning permission (this requires a Section 42 application)

What permissions a Non-Material Variation applies to

You can only submit a non-material variation for a grant of planning permission. It is not a new consent and is tied to the original permission.

You cannot use this process for:

  • Listed Building consent
  • Conservation Area consent
  • advertisement applications
  • prior notifications

Who can apply

The request must be made by the person who was granted planning permission, or someone acting with their consent. This includes successors in title to the land.

How to apply

You can submit your request online.

If you need to provide supporting documents, you must upload them electronically through the ePlanning.scot portal after submitting the online form. Select ‘Post Submission Additional Documents (PSAD)’ when uploading information.

Fees

All non-material variation requests are subject to a fee. Quote NMV when making your payment.

We cannot process your request until the fee has been received.
