Rules for storing materials on a public road
If you need to store materials on a public road or pavement, there are important rules you must follow to ensure public safety and minimise disruption.
Removal of materials
Materials must be removed as soon as they are no longer required. If the Council or Police Scotland requests their removal, you must comply within 24 hours. Once your permit has expired, all materials must be cleared unless you have applied for and received an extension.
Prohibited Materials
You are not allowed to store materials that are:
- flammable
- explosive
- noxious
- otherwise hazardous
Materials that may rot or cause a nuisance to the public are also prohibited.
Mixing on the Road Surface
Mixing substances such as concrete, mortar, or grout directly on the road or pavement is not permitted under any circumstances.
Restoring the area
At the end of your works, you must return the road or pavement to its original condition. If the reinstatement is not completed to a satisfactory standard, or if it is not maintained for at least 12 months, the Council may carry out the necessary repairs and recover the costs from you.
Placement of materials
Materials should be positioned as close to the edge of the carriageway as reasonably possible. They must not obstruct drainage, manholes, or access to utility services. Materials should be grouped together to minimise obstruction and must not block access to any property unless you have obtained consent from the occupier.
As the permit holder, you are fully responsible for the safety and legality of the storage. Materials must be placed in a way that does not endanger pedestrians or road users. We must be indemnified against any claims or losses resulting from the occupation of the road or pavement.
Access and safety requirements
You must maintain the minimum widths for both carriageways and footways, as specified by the Council’s Community Services team. Where necessary, appropriate lighting, barriers, and traffic management measures must be provided in line with current regulations and to the satisfaction of the Area Community Services Manager.
