Compensation claims

If you are injured or your vehicle is damaged due to a fault or defect in infrastructure we maintain, you may be able to make a compensation claim.

How to make a claim

To request a compensation claim form for damage to your vehicle or personal injury, contact us Monday to Friday, 8am to 5pm on 01349 886601. A member of our team will send the form to you by post or email.

Once we receive your completed form and supporting evidence, we will:

  1. acknowledge your claim
  2. pass it to our insurers for consideration

Our insurer will notify you of the outcome.

If your claim is accepted, our insurer will arrange payment.

Why some claims are rejected

We are not legally required to maintain roads and infrastructure in a completely defect-free condition at all times. A claim will only be successful if it can be shown that we breached our duty of care. This means not all damage claims, including those resulting from potholes, will qualify for compensation.

Insurance information

We are self-insured, paying compensation from our own funds for claim amounts up to £1,000,000. Any compensation amounts over £1,000,000 are handled by our insurance provider Zurich Municipal.

Fraudulent claims

Claims that are found to be false, exaggerated, or fraudulently submitted will be referred to the appropriate authority. Cases may be subject to criminal prosecution to protect public funds.
