Applicant responsibilities
5.1 - When children, protected adults, or adults who may be at risk are involved in activities during a letting - whether as committee members, staff, volunteers, or participants - the Applicant must have read and ensured compliance with the document Child and Adult Protection Guidance for Community Groups in Highland. This guidance also applies to self-employed individuals working with these groups.
5.2 - The Applicant is responsible for ensuring that a person or persons with appropriate experience and qualifications supervise and remain present throughout the let. There should also be a person present at the beginning and end of the let to oversee proper handover.
5.3 - The Applicant shall indemnify the Council against all costs, expenses, liabilities, injuries, losses, or damages arising from any act or omission by the Applicant, their agents, volunteers, or staff in relation to the hire or activities during the let.
5.4 - The Applicant must hold a public liability insurance policy with a minimum cover of £5 million for any one incident. The Applicant must provide the Council with a certified copy of a valid insurance policy if requested.
5.5 - The Applicant is responsible for obtaining all necessary licences and permits before the let begins. From 27 January 2021, a public entertainment licence is required for any public performance of a play. For further details, see our public entertainment page.
5.6 - The Applicant must ensure compliance with all relevant emergency and other regulations. Hirers should familiarise themselves with the Emergency Evacuation Procedures for the venue and inform their members or participants. All exits must be kept clear at all times. Emergency exits should only be used in case of emergency and not for routine access or egress.
5.7 - The Applicant must not display or attach materials such as posters, flyers, or signboards within or outside the premises without prior written approval from the Head Teacher. The Council reserves the right to charge for any damage caused by unauthorised use of such materials.
5.8 - The Applicant is responsible for ensuring all individuals wear suitable or appropriate footwear.
5.9 - Although every effort is made to keep pitches free of glass and debris, applicants are advised to inspect pitches before use. Broken glass and other debris can appear unexpectedly, and the Facilities Service will not be responsible for injuries caused by such hazards.
